The WTO has announced its decision that the European Union will be authorised to impose tariffs on USD 4 billion of US goods exported to the European Union every year. This follows four previous WTO panel and appellate reports from 2011 to 2019 confirming that subsidies to Boeing violate WTO rules. The decision finds that illegal subsidies to Boeing cost Airbus USD 4 billion dollars in lost sales and market share annually.

Airbus has agreed with the governments of France and Spain to make amendments to the A350 Repayable Launch Investment (RLI) contracts. After 16 years of litigation at the World Trade Organisation (WTO), this is the final step to stop the long-standing dispute and removes any justification for U.S. tariffs.

A WTO panel assessing the measures the EU and Airbus have taken to comply with the WTO recommendations has issued its findings. As a result of the panel’s findings, the US should immediately reduce the USD 7.5 billion in tariffs that the WTO authorised to the US in October by around USD 2 billion. This is the direct result of the panel finding that the loans for the development of the A380 no longer have an impact on Boeing sales and that therefore the value of the lost sales no longer exists.

If the United States Trade Representative (USTR) chooses to impose tariffs on the importation of aircraft and/or aircraft components, this will create insecurity and disruption not only to the aerospace industry, but also to the broader global economy. Yet it is still avoidable.

Airbus welcomes the report of the WTO Appellate Body, published today, which confirms that the United States failed to withdraw the subsidies granted by federal, state and local authorities to Boeing, and to remove the harm those subsidies caused to Airbus.
